Sources and Boundaries of Institutional and Linguistic Normativity. Towards a Critical Social Ontology.

2013

Since Hegel and until speech acts theory and contemporary social ontology it came to full development the idea that most of reasons, duties, rights, entitlements, have to do, against Kant, with our participation to social, linguistic and institutional practices of the lifeform to which we belong rather than or more than with our dealing with “substantive moral principles”. But if we accept, with Hegel, that every individual rational determination of the will is justified as such only as a part of our collective Sittlichkheit (Hegel, 1967, cf. Di Lorenzo Ajello, 2009); if we accept from speech acts theory that there are commitments, rights and entitlements specific to every type of speech ac…

The Role of Searle's Constitutive Rules for the Rational Criticizability of Institutional Reality

2013

My hypothesis is that we can derive the normative conditions that institutions and institutional acts have to meet in order to be rationally acceptable/recognizable from the logical structure of institutional reality. Developing Searle's achievements on the constitutive role of speech acts in the construction of institutional reality and on their character of institutional acts, I'll show that the same types of constitutive rules underlying illocutionary acts also underlie institutional reality. I’ll then argue that we can derive a specific set of normative criteria for the rational criticizability of institutional acts from these constitutive rules in the same way that we can derive normat…

Normativity and collective recognition in Searle's account of language and social ontology

2015

Constitutive Rules: The Symbolization Account

2021

Our aim is to provide an account of constitutive rules in terms of (1) the acceptance of regulative norms, and (2) a cognitive process we call “symbolization” (in an altogether different sense from what J. R. Searle means by this word). We claim, first, that institutional facts à la Searle boil down to facts concerning the collective acceptance of regulative norms in a given community. This, however, does not exhaust what institutional facts are. There is a residue, symbolization. Symbolization, as we understand it, involves a transfer of cognitive models from one domain to another. We introduce this notion by exploring different sorts of games, taking our cue from games of pretend play. In…

Come il diritto inventa le identità

2012

Does the identity recorded by documents certify what you are or affect your way of being? Do the different classes of subjects to which the rules grant rights or impose obligations exist before being utilized by law? Is the role conferred by the institutions a false mask that can be dismissed at the end of a working day or is it a stubborn demon that possesses the soul of the man and the citizen? These questions introduce the issue of this paper: the relationship between Law and identity, in particular the contribution of legal sphere to the construction or manipulation of collective identities such as gender, race, nationality or class. The author opts for a constructivist approach and des…

Reglas constitutivas: desde el paradima lógico-lingüístico al paradigma cognitivo

2022

In this chapter, starting from a criticism of J.R. Searle's conception of institutional reality, we develop a 'cognitive' interpretation of constitutive rules.
